Please read these terms carefully before using ActiveTax. By creating an account you agree to be bound by them.
1. Introduction and Definitions
These Terms of Service ("Terms") govern your access to and use of ActiveTax ("Service"), operated by ActiveSoft Ltd ("we", "us", "our"). By registering for an account, you agree to these Terms in full.
The following definitions apply throughout these Terms:
- "Service" means the ActiveTax Making Tax Digital software accessible at activetax.pages.dev and activetax.uk.
- "You" / "User" means the individual registered to use the Service.
- "HMRC" means His Majesty's Revenue and Customs.
- "MTD" means Making Tax Digital, the UK government's initiative for digital tax record keeping and submission.
2. Account Registration
To use ActiveTax you must:
- Provide accurate and complete registration information
- Be a UK taxpayer subject to Income Tax Self Assessment
- Be at least 18 years of age
- Keep your login credentials secure and not share them with others
You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@activetax.uk.
3. Service Description
ActiveTax is HMRC-recognised Making Tax Digital software designed for self-employed individuals and landlords. The Service provides:
- Digital income and expense record keeping
- Quarterly update submissions to HMRC
- Tax calculations and estimates
- Final declarations to HMRC
- Secure storage of your HMRC connection and tax data
4. Subscription Plans
ActiveTax offers a free plan and a paid Standard plan. Current pricing is displayed on our Pricing page.
- Free plan: Includes core MTD features at no cost.
- Standard plan: Includes additional features as described on the Pricing page. Billed monthly or annually.
We reserve the right to change pricing with at least 30 days' notice to existing subscribers by email. Continued use after the effective date constitutes acceptance of the new pricing.
5. Your Obligations
You are responsible for:
- The accuracy of the tax data you enter into ActiveTax
- Maintaining your own underlying records (receipts, invoices, bank statements) as required by HMRC
- Meeting all HMRC submission deadlines
- Ensuring your tax affairs are compliant with all applicable laws
ActiveTax is a software tool, not a tax adviser. Nothing in the Service constitutes tax, legal, or financial advice. For specific tax guidance, you should consult a qualified tax professional.
6. HMRC Integration
ActiveTax acts as a software intermediary between you and HMRC. When you connect your HMRC account:
- You authorise ActiveTax to access HMRC's APIs on your behalf using the OAuth2 protocol. You may revoke this authorisation at any time from your account settings or directly via your HMRC online account.
- We are legally required to include fraud prevention headers in all HMRC API requests, as mandated by HMRC. This includes a device identifier stored in your browser's local storage.
- Data submitted to HMRC via ActiveTax is subject to HMRC's own terms and policies.
7. Intellectual Property
All content, design, trademarks, and software comprising the ActiveTax Service are the intellectual property of ActiveSoft Ltd or its licensors. You may not copy, reproduce, or redistribute any part of the Service without our prior written permission.
"Making Tax Digital" is a trademark of HMRC and is used with permission. ActiveTax is not affiliated with or endorsed by HMRC beyond its status as a recognised MTD software provider.
You retain full ownership of your tax data. We do not claim any rights over the data you enter into ActiveTax.
8. Data Protection
We handle your personal data in accordance with our Privacy Policy, which forms part of these Terms. By using ActiveTax, you consent to our processing of your data as described in that policy.
9. Limitation of Liability
To the fullest extent permitted by law:
- ActiveTax is not a tax adviser and does not guarantee the accuracy of tax calculations, which depend on data provided by you and HMRC's own systems.
- We are not liable for any penalties, interest, or losses arising from late, incorrect, or missed HMRC submissions.
- Our total liability to you for any claim arising from or related to the Service is limited to the total fees you have paid to us in the 12 months preceding the claim.
- We are not liable for any indirect, consequential, or special losses.
Nothing in these Terms excludes or limits our liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
10. Service Availability
We aim to provide a reliable service but cannot guarantee uninterrupted availability. The Service depends on third-party infrastructure including HMRC's APIs and Amazon Web Services. We are not liable for unavailability caused by these third parties.
We will endeavour to notify you of planned maintenance in advance where possible.
11. Termination
By you: You may delete your account at any time from your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
By us: We may suspend or terminate your account if you breach these Terms, use the Service fraudulently, or for any other reason at our reasonable discretion, with notice where practicable.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. The "Last updated" date at the top of this page will always reflect the most recent revision. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
